TERMS AND CONDITIONS / RELEASE OF LIABILITY
The medical marijuana patient (the patient) must be able to provide proof of identity, proof that the patient has an Oklahoma state residence, can prove your identity with a government issued ID, and are legally able to obtain an approval or recommendation for a medical cannabis license (medical marijuana) as dictated by legislation governed by the Oklahoma Medical Marijuana Authority (OMMA) (OAC 310 : 681)

The physician does NOT make the final approval of applications submitted for an Oklahoma medical cannabis license and the patient must personally submit their application on-line at www.omma.ok.gov within thirty (30) days of a physician’s authorization along with all of the required appropriate supporting documentation, a picture, and the required license fee in order for the OMMA to evaluate issuing the patient a medical cannabis license as dictated by legislation (OAC 310 : 681)

In requesting a medical marijuana recommendation, you have fully affirmed that you have a serious medical condition that adversely affects your quality of life. The patient has found or are interested in finding out whether cannabis (medical marijuana) provides substantial relief and improvement in their condition.

The cannabis plant is not regulated by the United States Food and Drug Administration (FDA), although it is regulated by the Oklahoma Medical Marijuana Authority (OMMA). In requesting a recommendation for a patient license to use this plant as medication, the patient assumes full responsibility for any and all risks (medical, occupational, legal, etc.) of this action.

Cannabis (medical marijuana) smoke contains chemicals known as tars that may be harmful to your health. Should respiratory problems or other ill effects be experienced in association with its use, cannabis use should be discontinued and reported to the physician.

Cannabis (medical marijuana) may affect your coordination and cognition in ways that could impair your ability to drive, operate machinery, or engage in potentially hazardous activities. The patient assumes full responsibility for any harm resulting to the patient and/or other individuals as a result of your elective use of cannabis.
According to OAC 310 : 681, the OMMA provides for the possession and cultivation of cannabis (medical marijuana) for personal medical use with a physicians recommendation. The physician does not provide cannabis nor does the physician encourage any illegal activity in obtaining cannabis (medical marijuana)

Pregnant of breastfeeding women should not use any cannabis product. Women who are planning on becoming pregnant should stop all cannabis use before conception.

If you have any questions regarding the legality of an activity involving your use of cannabis (medical marijuana), it is the patients responsibility to visits the OMMA website listed above where the answers to such questions may be obtained.

The patient has requested a consultation by the physician for the purposes of determining the appropriateness of medicinal cannabis treatment. The patient understands that no claim about the medical efficacy of cannabis will be made by the physician. The physician is addressing specific aspects of the patient’s medical care and are in no way establishing themselves as the patient’s primary care provider. Should an approval be made for the patients medicinal use of cannabis, the patient understands that there is a renewal date of two (2) years on the license. The patient understands that at two years’ time, it is the patient’s responsibility to see the physician to assess the possible continuance of cannabis for another two year period.

In submitting an adult patient license recommendation form to the Oklahoma Medical Marijuana Authority (OMMA), the applicant agrees with the above statements and acknowledges each statement to be true. Furthermore, in requesting an OMMA adult patient license recommendation form, the patient, their heirs, assigns, or anyone acting on the patient’s behalf holds the physician and his principals, agents, employees and clinic absolutely free and harmless from any liability resulting from the use of cannabis.
